October 2023 New Lasting Beauty® Rewards Member Sweepstakes Official Rules
NO PURCHASE IS NECESSARY TO ENTER OR WIN. A PURCHASE OR PAYMENT OF ANY KIND WILL NOT INCREASE YOUR CHANCES OF WINNING.
Sponsor: This sweepstakes is sponsored by Colorescience, Inc., (the “Sponsor”) located at 2141 Palomar Airport Road, Suite 200, Carlsbad, CA 92011.
Eligibility: The Lasting Beauty® Rewards Sweepstakes (“the Sweepstakes”) is open to legal residents the fifty (50) United States and the District of Columbia, excluding Rhode Island, who are at least eighteen (18) years of age or older and who create a Lasting Beauty® Rewards member account (“Account”) during the Sweepstakes Period (defined below). Accounts are free to create. Employees of sponsor, affiliated companies, advertising or communications agencies and the immediate family of each employee are not eligible. Void in Rhode Island and where prohibited by law. Subject to all applicable federal, state, municipal and local laws. Open only to individuals who do not previously or currently have an active Lasting Beauty® Rewards account.
Sweepstakes Period: The Sweepstakes begins on October 1, 2023 at 12:00:00AM PST and ends at 11:59:59 p.m. PST on October 31, 2023 (the "Sweepstakes Period"). Colorescience’s computer is the official time keeping device for this Sweepstakes.
To Enter: Simply visit https://www.colorescience.com/account/register, and follow the links and instructions to create an Account, which is free to do. Limit one (1) entry per eligible person. Any attempt to enter more than the allowed number of times, whether by use of multiple identities, email addresses, Accounts, or otherwise, is grounds for disqualification. All entries are subject to verification by the Sponsor. Entries that do not meet the applicable requirements in these Official Rules are void. Any attempted form of entry other than as described herein is void. Proof of submission is not proof of receipt of account creation. All submissions must be completed and received during the Sweepstakes Period to be eligible.
Winner Selection and Notification: One (1) potential winner will be selected, on November 15th, 2023, at random from among all eligible entries received. The potential winner will be notified via email using the email address associated with his/her Account, and must respond to such notification within 72 hours. Failure to respond may result in disqualification and award of prize to an alternate winner, as will any determination that a potential winner is ineligible or has failed to comply with these Official Rules.
Prize: One (1) Prize is available: $250-worth of Colorescience products. Colorescience reserves the right to replace any out-of-stock items with in-stock products of equal or higher retail value. Prize shipment limited to U.S. addresses only. Allow up to four weeks after validation of prize claim for delivery of prize. Prizes cannot be transferred, assigned, or redeemed for their cash value. All prizes will be awarded “AS IS” and “WITHOUT WARRANTY OF ANY KIND” express or implied (including, without limitation, any implied warranty of merchantability or fitness for a particular purpose), other than any standard warranty from the manufacturer. Any taxes, fees and expenses relating to the acceptance and use of the Prize not specified are the responsibility of the winner.
Odds of Winning: Odds of winning a prize depend on the number of eligible entries received.
Data Privacy: Any information you submit is subject to Sponsor’s Privacy Policy posted at: https://www.colorescience.com/privacy-policy
Limitation of Liability: If for any reason, Colorescience chooses to cancel the campaign after the first month, it may do so at its own discretion without selecting a winner in the following months.
Social Network Disclaimers: This Sweepstakes is being sponsored exclusively by Colorescience and is not affiliated with or endorsed by any other website or social media platform, including Facebook, Instagram, TikTok, Twitter, etc., where advertising for the Sweepstakes may appear.
Winner List: For the name of the winner, available after 11/30/23, send a self-addressed, stamped envelope to Lasting Beauty® Rewards Sweepstakes – October 2023, Colorescience, Inc., 2141 Palomar Airport Road, Suite 200, Carlsbad, CA., 92011. Requests must be received by 12/31/2023.
Release: Sponsor assumes no responsibility for: (1) technical delays or failures of any kind, (2) unauthorized human intervention during any part of the Sweepstakes, (3) technical or human error during the administration or processing of the Sweepstakes, or (4) any loss, injury, or damage caused, whether directly or indirectly, in whole or in part, from downloading data or otherwise participating in the Sweepstakes. By entering into this Sweepstakes, participants agree to release and hold harmless the Sponsor and its’ subsidiaries, affiliates, suppliers, distributors, advertising/promotion agencies and each of their respective parent companies and each company’s officers, directors, employees and agents from and against any claim or cause of action, including, but not limited to, damage to or loss of property, arising out of participation in the Sweepstakes or receipt or use or misuse of any prize.
Additional Terms: The Sponsor reserves the right to cancel, suspend and/or modify the Sweepstakes, or any part of it, if any fraud, technical failures or any other factor beyond the Sponsor’s reasonable control impairs the integrity or proper functioning of the Sweepstakes. If the Sweepstakes is terminated before the designated end date, Sponsor will (if possible) select winner(s) in a random drawing from all eligible, non-suspect entries unaffected by the problem. Inclusion in such drawing shall be each entrant’s sole and exclusive remedy in such circumstances.
Sponsor reserves the right in its sole discretion to disqualify any individual who is found to be tampering with the entry process or the operation of the Sweepstakes, to be acting in violation of these Official Rules, or to be acting in an unsportsmanlike or disruptive manner, or with the intent to disrupt or undermine the legitimate operation of the Sweepstakes, or to annoy, abuse, threaten or harass any other person, and Sponsor reserves the right to seek damages and other remedies from any such person to the fullest extent permitted by law. No mechanically reproduced, illegible, incomplete, forged, software-generated or other automated multiple entries will be accepted.
In the event of a dispute as to the identity of the entrant, any on-line entry will be deemed submitted by the authorized account holder of the e-mail address associated with the Account associated with the entry, provided such account holder must still meet the eligibility requirements for the Sweepstakes. The authorized account holder shall be the natural person to whom the applicable email address has been assigned by the Internet access provider, service provider, or other online organization responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.
Only the type and quantity of prizes described in these Official Rules will be awarded. If, for any reason, more bona fide winners come forward seeking to claim prizes in excess of the number of each type of prize set forth in these Official Rules, the winners, or remaining winners, as the case may be, of the advertised number of prizes available in the prize category in question may be selected in a random drawing from among all persons making purportedly valid claims for such prize(s). Inclusion in such drawing shall be each entrant’s sole and exclusive remedy in such circumstances.
Applicable Laws and Jurisdiction: This Sweepstakes is subject to all applicable federal, state, and local laws and regulations. Issues concerning the construction, validity, interpretation and enforceability of these Official Rules shall be governed by the laws of the State of California, without regard to any principles of conflict of laws. All disputes arising out of or connected with this Sweepstakes will be resolved individually, and without resort to class action, exclusively by a state or federal court located in San Diego, California. Should there be a conflict between the laws of the State of California and any other laws, the conflict will be resolved in favor of the laws of the State of California. To the extent permitted by applicable law, all judgments or awards shall be limited to actual out-of-pocket damages (excluding attorneys' fees) associated with participation in this Sweepstakes and shall not include any indirect, punitive, incidental and/or consequential damages.
